Section 1  Scope of Applicability

The following General Terms and Conditions (T&Cs) govern the contractual relationship between Behnen & Scheufler GbR, Oberkasseler Straße 74-76, 40545 Düsseldorf, Germany (hereinafter referred to as “Trooves”) and the persons who use the informational website (blog) found at “trooves.com” (hereinafter referred to as “Visitors”). The version applicable at such time as the contract is concluded shall be the version currently valid. The contractual language is German. Any T&Cs of the Visitor’s shall not be covered in the contract.

Section 2  Use of Blog

In its blog, which is accessible by visiting “trooves.com”, Trooves reports on current trends and ideas from the world of furniture and accessories. The information provided by Trooves is provided without any warranty. If and insofar as Trooves reports on products that are not available in their affiliated online shop, it shall not be held liable for either the availability of or any pricing information about the products described in the blog.

Section 3  Limitation of Liability

Trooves shall only be held liable for damages suffered by the Visitor as a result of wilful or negligent action by a legal representative, employee or vicarious agent of Trooves and that are considered typically foreseeable damages. This exclusion of liability shall not apply to damages resulting from injury to life, limb or health. Liability for undeserved official measures, labour disputes, acts of God, natural disasters or accidental damage is excluded.

Section 4  Final Provisions

(1) If the Visitor is a merchant, a corporate body under public law or a special fund under public law, the only place of jurisdiction for any and all disputes shall be Düsseldorf. The same shall apply to persons with no general place of jurisdiction in Germany or persons who have moved their address or habitual place of residence outside of Germany after the contract has been concluded, as well as those whose address or habitual place of residence is unknown at such time as legal action is initiated.

(2) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the Visitor is a natural person and uses the blog for a purpose that cannot be attributable to their professional or commercial activities (consumer), the mandatory consumer protection provisions of the country in which the Visitor ordinarily resides shall nevertheless apply.
